Based on Article 7 of Law no. 119\/2014 “On the right to information” (hereinafter “LDI”), the National Cannabis Control Agency (hereinafter “Agency”) publishes the Transparency Program (hereinafter “PT”) approved by the Commissioner for The Right to Information and Protection of Personal Data (hereinafter “Commissioner”). The Agency publishes information related to its operational activities and updates the PT whenever there are changes in institutional activities, legal regulations, or other elements impacting proactive transparency.
\nWithin the Agency’s PT, specific categories of mandatory information for public disclosure are outlined. Unsolicited public information must be complete, accurate, up-to-date, easy to access, understandable, and compatible with the original documents in the possession of the Agency. Before publication, the Agency conducts assessments to ensure compliance with any legal restrictions on information dissemination.
\nActs containing rules, norms, or limitations affecting fundamental rights and freedoms, with direct implications for individuals, are promptly made public through postings on the official website within 48 hours of their approval by the Agency. The PT specifies the categories of information to be made public, the methods of publication, and the legal obligations governing publication. When releasing information, the Agency prioritizes the public interest and facilitates straightforward access to public information.

Leadership and Organization<\/span><\/strong><\/p>\n The National Agency for Cannabis Control is a public legal entity under the authority of the minister responsible for health.<\/span><\/p>\n Its mission is to oversee, control, and inspect the cultivation and processing of cannabis plants, and the production of its by-products for medical and industrial purposes, as well as to monitor the implementation of the law.<\/span><\/p>\n The Agency is headquartered in Tirana and operates throughout the territory of the Republic of Albania.<\/span><\/p>\n It was established in accordance with Law 61\/2023 “On the control of cultivation and processing of cannabis plants and the production of its by-products for medical and industrial purposes.”<\/span><\/p>\n The Agency is led by a Director-General, who organizes and manages all activities of the institution and reports to the minister responsible for health.<\/span><\/p>\n The Licensing Commission is established alongside the Agency. It consists of 7 members representing the Ministry of Health and Social Protection, the Ministry of Interior, the Ministry of Agriculture and Rural Development, and the Ministry of Economy.<\/span><\/p>\n The employment relations of Agency staff are regulated according to the Labor Code.<\/span><\/p>\n Employees of the Agency must demonstrate integrity and have a clean moral record. They must not have been convicted by a final court decision for a criminal offense related to narcotics.<\/span><\/p>\n Individuals employed by the National Cannabis Control Agency must meet general requirements as well as criteria for personal integrity, and specific professional criteria for specific job positions. The professional criteria for Agency employees, as well as verification of their integrity, are defined by joint guidance from the Minister responsible for internal affairs and security, the Minister responsible for agriculture, and the Minister responsible for health, upon the proposal of the Director General of the Agency.<\/span><\/p>\n The Licensing Commission<\/span><\/strong><\/p>\n The Licensing Commission is established alongside the Agency to review and evaluate applications submitted for obtaining a license for cannabis cultivation. The Commission consists of 7 members with the following composition:<\/span><\/p>\n The Chairman of the Commission is one of the representatives from the ministry responsible for health. Commission members are appointed for a term of up to 4 years.<\/span><\/p>\n Commission members have the obligation to sign a confidentiality declaration, a declaration of absence of conflict of interest, and must be equipped with a security clearance certificate from the Classified Information Security Directorate.<\/span><\/p>\n The duties of the Licensing Commission include:<\/span><\/p>\n The organization of work and activities of the Commission are established by order of the Minister responsible for health. Commission members perform their duties against remuneration. The amount of remuneration for the Chairperson and members of the Commission is determined by decision of the Council of Ministers for setting the remuneration scale for members of permanent councils, boards, or commissions of central government units.<\/span><\/p>\n <\/p>\n Competencies of the Agency<\/strong><\/p>\n <\/p>\n 1)\u00a0\u00a0\u00a0 Organizes procedures for the issuance of licenses.<\/p>\n 2)\u00a0\u00a0\u00a0 Monitors the operations of licensed and permitted entities.<\/p>\n 3)\u00a0\u00a0\u00a0 Establishes standards for areas and land parcels where cannabis cultivation for medical and industrial purposes is permitted, approved by the Council of Ministers upon proposal from the Ministry of Agriculture.<\/p>\n 4)\u00a0\u00a0\u00a0 Prepares every 3 years report on compliance with license and permit conditions, recommending amendments, suspensions, or revocations as necessary.<\/p>\n 5)\u00a0\u00a0\u00a0 Collaborates with other competent authorities to achieve objectives and fulfill obligations arising from international agreements involving Albania.<\/p>\n 6)\u00a0\u00a0\u00a0 Submits reports to relevant international organizations on the import and export of cannabis plants, by-products, and final products, in line with international conventions on narcotic and psychotropic substances.<\/p>\n 7)\u00a0\u00a0\u00a0 Maintains and manages registries, databases, and national-level statistics as required by law.<\/p>\n 8)\u00a0\u00a0\u00a0 Issues export authorizations for industrial cannabis and cannabis products.<\/p>\n 9)\u00a0\u00a0\u00a0 Drafts regulations, guidelines, and methodologies to standardize the Agency’s processes and work practices, subject to approval by the Minister of Health.<\/p>\n 10)\u00a0 Proposes to the Ministers of Agriculture and Environment the cadastral zones designated for industrial cannabis cultivation.<\/p>\n 11)\u00a0 Implements administrative measures, fines, and suspensions on licensed and permitted entities under this law.<\/p>\n 12)\u00a0 Evaluates requests for the sale of shares by license-holding entities and recommends approval to the Minister of Health for licenses and the Minister of Agriculture for permits.<\/p>\n 1)\u00a0\u00a0\u00a0 Monitors the use and planting of imported or domestically produced seeds and seedlings in Albania, in compliance with current laws on planting material and propagation and registered in the national catalog.<\/p>\n 2)\u00a0\u00a0\u00a0 Develops standards for each phase of the cannabis cultivation process, approved under the guidance of the Minister of Agriculture.<\/p>\n 3)\u00a0\u00a0\u00a0 Coordinates with relevant state authorities for the registration and immediate inclusion in the national catalog of seeds and seedlings, subject to distinctness, uniformity, and stability (DUS) testing.<\/p>\n 4)\u00a0\u00a0\u00a0 Monitors and supervises the planting and cultivation of cannabis plants and their by-products for medical and industrial purposes, taking corrective actions if discrepancies in actual versus permitted cultivation quantities are identified.<\/p>\n 5)\u00a0\u00a0\u00a0 Inspects all stages of cannabis cultivation, including planting, harvesting, drying, storage, and initial processing.<\/p>\n 6)\u00a0\u00a0\u00a0 Inspects facilities and premises where processing of by-products and final products for medical purposes occurs, adhering to licensing requirements.<\/p>\n 7)\u00a0\u00a0\u00a0 Implements measures for the seizure and destruction of cannabis plants or by-products as specified by law.<\/p>\n 8)\u00a0\u00a0\u00a0 Collaborates with customs authorities to oversee the import regime of seeds and seedlings, as well as the export regime of medical and industrial cannabis by-products or final products.<\/p>\n 9)\u00a0\u00a0\u00a0 Carries out any other activities mandated by other laws or subordinate legislation in the implementation of this law.<\/p>\n <\/p>\n Functions of the Agency<\/strong><\/p>\n 1)\u00a0\u00a0\u00a0 Are carried out in accordance with the provisions of laws and by-laws issued based on and for their implementation, with the stipulations
